1. Acceptance of Terms

By downloading, installing, accessing, or using the NIV Bible mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and NIV Bible App ("we," "us," or "our"). Your continued use of the App signifies your acceptance of any updates or modifications to these Terms.

2. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal mobile device(s)
• Access and use the App's features for personal, non-commercial purposes
• Read, listen to, and study the New International Version (NIV) Bible text and audio

License Restrictions

You may NOT:

• Modify, reverse engineer, decompile, or disassemble the App
• Copy, redistribute, or resell the App or its content
• Remove or alter any proprietary notices or labels
• Use the App for any illegal or unauthorized purpose
• Extract or download the Bible text in bulk for commercial use

3. User Obligations

When using the NIV Bible App, you agree to:

• Provide Accurate Information: Supply truthful and current information when creating an account
• Maintain Security: Keep your login credentials confidential and secure
• Report Issues: Notify us immediately of any unauthorized account access
• Follow Laws: Comply with all applicable local, state, national, and international laws
• Respect Others: Interact respectfully with other users in community features
• Update Information: Keep your account information current and accurate

You are solely responsible for all activity that occurs under your account.

4. Intellectual Property Rights

All content within the NIV Bible App is protected by intellectual property laws:

Bible Text & Translation

The New International Version (NIV) Bible text is copyrighted by Biblica, Inc.™ and used under license. Quotations from the NIV text must follow these guidelines:

• Up to and including 500 verses may be quoted without written permission
• Quotations must not comprise more than 25% of the work in which they appear
• Proper attribution must be given: "Scripture quotations taken from The Holy Bible, New International Version® NIV®"

App Content

The App's design, features, graphics, user interface, audio recordings, reading plans, and all original content are owned by us or our licensors and protected by:

• Copyright laws
• Trademark laws
• Patent laws
• Trade secret laws

5. User-Generated Content

The App may allow you to create, share, or submit content such as:

• Personal notes and highlights
• Prayer requests and journal entries
• Community discussions and comments
• Shared reading plans or study guides

Your Rights

You retain ownership of content you create. However, by sharing content through the App, you grant us a worldwide, non-exclusive, royalty-free license to:

• Use, reproduce, and display your content within the App
• Modify or adapt your content for technical compatibility
• Distribute your content to other users as you direct

Your Responsibilities

You represent and warrant that:

• You own or have permission to use the content you submit
• Your content does not violate any third-party rights
• Your content complies with these Terms and applicable laws
• Your content is not offensive, harmful, or inappropriate

6. Prohibited Conduct

You agree NOT to engage in any of the following activities:

Technical Violations

• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Use automated tools (bots, scrapers) to access the App
• Introduce viruses, malware, or harmful code
• Circumvent security features or access restrictions

Content Violations

• Post false, misleading, or deceptive content
• Share content that is hateful, threatening, or harassing
• Distribute spam, advertising, or promotional material
• Infringe on intellectual property rights
• Share sexually explicit or violent content

Usage Violations

• Impersonate others or misrepresent affiliations
• Use the App for commercial purposes without permission
• Collect or harvest user information
• Create multiple accounts to abuse features

7. Subscriptions & Payments

The NIV Bible App offers both free and premium subscription features:

Free Features

All users have access to:

• Complete NIV Bible text
• Basic search functionality
• Personal bookmarks and highlights
• Verse of the day

Premium Subscriptions

Premium features include:

• Full audio Bible narration
• Advanced study tools and commentaries
• Unlimited custom reading plans
• Ad-free experience
• Cloud sync across devices
• Offline access to audio

Billing Terms

• Payment: Subscriptions are charged through your app store account (Apple App Store or Google Play Store)
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Refunds: Refund policies are governed by the respective app store
• Price Changes: We may change subscription prices with 30 days' notice
• Cancellation: You may cancel anytime through your app store settings

8. Account Termination

Termination by You

You may terminate your account at any time by:

• Deleting your account through the App settings
• Contacting our support team
• Uninstalling the App (note: this does not delete your account data)

Termination by Us

We reserve the right to suspend or terminate your account if you:

• Violate these Terms or our policies
• Engage in fraudulent or illegal activities
• Abuse or harass other users or staff
• Fail to pay applicable fees
• Remain inactive for an extended period

Effects of Termination

Upon termination:

• Your access to the App will be immediately revoked
• Your user-generated content may be deleted
• Paid subscriptions will not be refunded (except as required by law)
• These Terms will continue to apply to past conduct

9. Disclaimers & Limitations of Liability

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness
• Warranties of uninterrupted or error-free service
• Warranties that defects will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or unavailability
• Errors, mistakes, or inaccuracies in content
• Unauthorized access to your data
• Third-party content or conduct

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless NIV Bible App, its officers, directors, employees, agents, and partners from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your user-generated content
• Your negligence or willful misconduct

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of this document
• Notify you via email or in-app notification for material changes
• Post the updated Terms in the App and on our website
• Provide a reasonable opportunity to review changes before they take effect

Your continued use of the App after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must discontinue using the App and cancel your account.

12. Governing Law & Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of [Your State], without regard to conflict of law principles.

Dispute Resolution

In the event of any dispute arising from these Terms or your use of the App:

1. Informal Resolution: Contact us first at legal@nivbibleapp.com to attempt resolution
2. Mediation: If informal resolution fails, parties agree to good-faith mediation
3. Arbitration: Unresolved disputes shall be settled by binding arbitration under the American Arbitration Association rules
4. Class Action Waiver: You agree to resolve disputes on an individual basis and waive the right to participate in class actions

Exceptions

Either party may seek injunctive relief in court for:

• Intellectual property infringement
• Unauthorized access or data breaches
• Violations requiring immediate legal intervention
